Terms & conditions

These Terms & Conditions govern purchases from Top Bloke through thetopbloke.co.uk. “Top Bloke”, “we”, “us” and “our” mean Top Bloke.

Please read these Terms and our Refund & Quality Policy before ordering. Our Privacy Policy explains how we use personal information and uploaded photographs; accepting these Terms is not consent to marketing.

These Terms are intended for customers buying wholly or mainly for personal use. Nothing in them excludes or limits your rights under the Consumer Rights Act 2015, the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, or any other consumer law that applies to your purchase.

1. Top Bloke products

Top Bloke creates personalised products using photographs supplied by customers. Each personalised calendar is made for the individual order.

Depending on the product purchased, your order may include personalised cover artwork, twelve monthly transformations, a printed calendar and associated digital artwork. The product description and order confirmation identify what is included, its format, size, calendar year and price.

The artwork shown on our website illustrates the product and its style. Your personalised images will differ, but the product must still match its description and meet your statutory rights. A product being made to order does not, by itself, remove consumer rights.

2. Customer eligibility

You must be at least 18 years old to order and legally capable of entering into the purchase.

You confirm that the information you provide is accurate and that you have the rights or lawful permission needed to submit each photograph for the personalisation you request, including when ordering a gift for somebody else.

Do not submit an image for use that infringes another person's copyright, privacy or other legal rights.

3. Photographs and customer-supplied content

You retain any rights you already hold in photographs you upload.

You grant us a limited, non-exclusive licence to copy, process, adapt and share that content with our service providers only as reasonably necessary to create and quality-check your artwork, print and fulfil your order, deliver included digital files, provide support and resolve problems with the order.

This licence does not permit us to sell your original photograph as a standalone image or use it for unrelated purposes. We will not publish your uploaded photograph or personalised order in advertising or promotional material without separate permission.

Personal information, retention and the use of service providers are explained in our Privacy Policy. This licence does not override your data-protection rights.

4. Photo quality

The quality and recognisability of the result depend partly on the photograph supplied.

For best results, use a clear, well-lit photograph showing one adult, with the face reasonably front-facing, large enough to see clearly and unobstructed. Avoid heavy blur, strong filters, deep shadows, very low resolution and face coverings.

A photograph that looks clear on a small screen may still be unsuitable if the face is tiny or heavily compressed. Follow the upload guidance displayed before placing your order.

5. Photo suitability and customer responsibility

We work from the photograph you provide. We do not take a new photograph or source a replacement image on your behalf.

Profile views, group photographs, cropped faces, obscuring eyewear or headwear, and poor lighting can limit the result. Please contact us promptly if you uploaded the wrong image.

We do not offer a discretionary refund, replacement or credit solely for limitations caused by an unsuitable source photograph where those limitations were clearly explained before purchase and we have supplied the product as agreed.

This is not a blanket exclusion for poor personalisation. We remain responsible for our own errors and for supplying a product that meets the description and legal quality standards. We will assess concerns fairly, including whether a claimed photo limitation actually caused the problem. If we identify a photograph we cannot reasonably use, we may request another image or explain the options before proceeding.

6. Personalised artwork and artistic variation

Top Bloke transformations are deliberately humorous, stylised and exaggerated. They use creative and automated image-processing techniques, including AI-assisted generation.

Artwork may change body proportions, clothing, pose, surroundings, expression, lighting and character styling. The intention is a recognisable, entertaining transformation rather than an exact photographic reproduction.

Minor artistic variation is expected. An exact reproduction of every facial detail or expression is not guaranteed. However, this does not excuse a product that fails to match its description, a significant likeness failure attributable to our production, obvious image corruption or other faults that breach your consumer rights.

We check for obvious generation, composition and printing problems. Our quality checks do not replace your statutory rights.

7. Ordering, acceptance and changes

Please review your photograph, product selection, quantity, personalisation and delivery details before submitting an order.

Submitting an order is an offer to buy. We accept it when we send an order confirmation expressly confirming acceptance. A payment authorisation or an automated acknowledgement that only confirms receipt of your order is not, by itself, acceptance.

If we cannot accept an order, we will tell you and promptly refund any payment taken for it. If we discover a pricing or description error before acceptance, we will explain it and ask whether you wish to proceed on the corrected basis; we will not charge more without your agreement.

Personalisation and production preparation may start shortly after acceptance. Contact contact@thetopbloke.co.uk immediately if you need a change or cancellation. We will try to help, but changes and voluntary cancellations may not be possible once work has started.

The legal position for clearly personalised goods is explained in our Refund & Quality Policy. Starting production does not remove rights relating to a faulty product, non-delivery or another breach of contract.

8. Customer details

Please check the recipient's name, email address, complete delivery address and postcode, photograph, quantity and product choices carefully.

Tell us promptly about any error. If a problem arises solely from incorrect details you supplied, reasonable additional production or delivery costs may be payable, as explained and agreed with you beforehand.

We will not charge you for correcting our own mistakes or use this section to exclude statutory rights.

9. Pricing and payment

Prices are shown in pounds sterling (GBP) unless clearly stated otherwise. Displayed consumer prices include applicable VAT. Any delivery charges and optional extras are shown before you commit to pay.

The total payable is displayed at checkout. Optional extras require your agreement; they are not added through pre-selected choices.

Payments are handled through the payment methods offered at checkout. We do not require you to send full card details by email. Information about payment-related personal data appears in our Privacy Policy.

A discount or sale does not reduce your consumer rights.

10. Made-to-order production

Each personalised calendar is produced for its individual customer. We may use specialist image-processing, printing, production, delivery and fulfilment providers.

Top Bloke remains responsible to you for performing the contract and remains your point of contact. You do not have to pursue our printer, image-processing supplier or delivery company to exercise your rights against us.

11. Delivery

Delivery destinations, charges and the applicable delivery timeframe are shown before purchase. We will deliver within the period agreed with you. If no different delivery period has been agreed, delivery will take place without undue delay and within 30 days after the contract is made.

An estimated dispatch date is not the same as a guaranteed delivery date. Please tell us before ordering if delivery by a particular date is essential, so that we can confirm whether we can meet it.

If we miss an agreed delivery deadline, you can normally give us an appropriate additional period to deliver. If we still do not deliver, you can end the contract and obtain the refund the law requires. You may be able to end it immediately if we refuse to deliver or timely delivery was essential in the circumstances or was made essential before the contract.

Where we arrange delivery, the goods remain at our risk until they come into your physical possession or that of a person you identify to receive them, other than the carrier. If you independently appoint a carrier that we did not offer, different statutory risk rules may apply.

Contact us about missing or damaged deliveries. We will investigate with the carrier without making your legal rights depend on the carrier completing its investigation. A tracking scan alone will not automatically determine a disputed delivery.

12. Digital artwork

Where digital artwork is included, you may download it, keep it, share it privately with family and friends and post it on your personal social-media accounts.

To the extent we hold the relevant rights, we grant you a personal, non-exclusive licence for those uses. Without our permission, do not resell or commercially license our artwork, reproduce it as competing merchandise, create counterfeit Top Bloke products or suggest we endorse an unrelated business.

This does not transfer ownership of your original photograph to us or restrict rights you already hold in it.

Please download and back up files within any availability period clearly disclosed before purchase. We do not promise indefinite online storage, but will honour the access period and functionality agreed with you.

Digital content must meet the legal standards that apply, including where it is described as a free extra supplied only with a paid order.

Where a separate statutory cancellation right applies to digital content supplied online, that right is not removed merely because the physical calendar is personalised. Before supplying that digital content during its cancellation period, we will obtain your express consent to early supply and acknowledgement that you will lose that cancellation right when supply begins, and confirm this in a form you can keep. Simply accepting these Terms is not that consent. Rights concerning faulty digital content remain unaffected.

13. Top Bloke intellectual property

We and our licensors retain applicable intellectual-property rights in our branding, logos, calendar templates, graphic designs, website content, slogans and proprietary artwork elements.

Purchasing a product does not transfer those rights. Your permitted use of included digital artwork is set out above. Nothing in this section claims exclusive rights in material that we do not own or limits a use the law permits.

14. Prohibited content

Do not upload unlawful material, content you have no right to use, or content intended to infringe rights, commit fraud, unlawfully impersonate somebody, harass, threaten or exploit another person.

We may decline an order where its content creates a reasonable legal or safety concern, or where we cannot fulfil it. We will explain the position where lawful and appropriate.

If we cancel an accepted order that we will not fulfil, we will refund the sums paid for the unfulfilled order unless the law requires otherwise. We do not impose an automatic forfeiture or penalty for cancellation. This does not prevent a separate lawful claim concerning deliberate wrongdoing.

15. Privacy

Our Privacy Policy explains how we handle personal information, uploaded photographs and support enquiries.

We use information for the purposes explained there and in accordance with applicable data-protection law. Permission for promotional use of customer photographs is separate from permission to fulfil an order.

16. Refunds and consumer rights

Clearly personalised calendars are generally excluded from the standard 14-day change-of-mind cancellation right for online goods purchases under regulation 28(1)(b) of the Consumer Contracts Regulations 2013.

That exception does not remove rights where goods are faulty, not as described, not fit for purpose or not delivered as required.

Our Refund & Quality Policy explains the short-term right to reject faulty goods, repair or replacement, other remedies and digital-content rights. It forms part of these Terms. If a summary on another page conflicts with a non-excludable consumer right, that right takes priority.

17. Our responsibility for loss or damage

If we breach the contract or fail to use reasonable care and skill, we are responsible for loss or damage you suffer that is a foreseeable result of that breach or failure.

We do not exclude or limit liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any liability or consumer right that cannot lawfully be excluded or limited.

These products are supplied for personal use. We do not accept liability for business losses arising from business use outside that agreed purpose, to the extent the law permits.

We are not responsible for a problem to the extent it was caused solely by your misuse or incorrect information, but this does not exclude our responsibility for our own acts or omissions. There is no blanket exclusion for carrier delays, supplier errors or loss in transit.

18. Responsibility for rights in uploaded material

You are responsible for obtaining the rights or lawful permission needed for the photographs you submit.

If you knowingly submit material you have no right to use and that causes us a foreseeable loss, you may be responsible to the extent the law permits. This is not an unlimited indemnity and does not make you responsible for our negligence, unlawful conduct or breach of duty.

19. Events outside our control

If an event outside our reasonable control affects an order, we will contact you as soon as reasonably possible and take reasonable steps to limit the effect and resume performance.

This does not remove your rights concerning delivery deadlines, non-delivery, cancellation for breach or refunds for goods or services not supplied.

20. Changes to these Terms

We may update these Terms for future orders. The version made available and agreed when you ordered applies to that order, unless we agree a lawful change with you.

We will not apply a later change retrospectively to reduce your rights. If part of these Terms is unenforceable, the remaining provisions continue to apply where they can operate fairly and lawfully.

21. Governing law and disputes

These Terms are governed by the law of England and Wales. This choice does not deprive you of mandatory consumer protections that apply where you live.

If you live in Scotland or Northern Ireland, you may bring proceedings in the courts of the part of the UK where you live. Consumers in England and Wales may bring proceedings in the courts of England and Wales. Nothing in this section removes any other right to bring proceedings in a court available to you under applicable law.

Please contact us first if something has gone wrong. Using our complaints process does not prevent you from exercising your legal rights.
